Two victims have sent legal notices against Dr. S. M. Manjur Elahi, Civil Surgeon of Barishal, and Dr. Shyamal Krishna Mondal, Divisional Director of Health in Barishal.

The victims are residents of Barakotha Union under Uzirpur Police Station in Barishal district.
Victims are  Mehedi Hasan, son of Anwar Hossain, resident of Malikanda, Uzirpur Police Station and  Shahadat Hossain, son of Abul Kalam Azad, resident of Goria, Uzirpur Police Station.

According to the details in the legal notice, Mehedi Hasan stated that he passed the examination for the post of Health Assistant held on May 30, 2025, conducted by the Barishal Divisional Civil Surgeon’s office.

Based on the online-based chart, he found that his viva voce was scheduled for June 23, 2025, and even received an SMS confirmation.
As he had his BA Honours Bengali National Language exam on that date, he informed the office. The authorities then told him that since he had an exam on that day, he could attend the viva on June 26, 2025.

Accordingly, when he appeared at 9:00 AM on June 26 for the viva, the officials delayed and refused to take his exam, saying the viva had already concluded on the previous date and he had been marked absent. He was told that his viva would not be taken again.

The second victim, Shahadat Hossain, stated that he also passed the Health Assistant exam held on May 30, 2025. However, without conducting his viva or informing him via phone or SMS, he received a text on June 25, 2025, at 10:20 AM from 01724-970307 stating that he needed to present a proper Chairman Certificate from the relevant Union Parishad at both his current and permanent addresses. He was instructed to appear at the office of the Divisional Director (Health) in Barishal at 4:00 PM on June 26, 2025.

He complied and appeared with all necessary documents, but the officials refused to accept them, saying his viva date had passed and he had been marked absent. They told him to contact the number from which the SMS had come.

Having no other option, the victims resorted to legal action and issued a legal notice against the concerned officials. They stated that if no resolution comes through this notice, they will be compelled to take further legal steps, as this job is a matter of life and death for them.

In tears, both victims said , fascism has still not disappeared from this country.. 
Senior lawyer of Barishal Bar and Assistant Public Prosecutor Adv Hafiz Ahmed Babul said, the allegations are true, which is why a legal notice has been issued initially. If a proper response is not given, further legal action will be taken against them.
