Court seeks permission from ministry to file case against Sylhet DC Sarwar Alam

The court has sought permission to file a case against Sylhet Deputy Commissioner Md. Sarwar Alam for non-cooperation in the investigation of the murder case filed in the case of the death of a young man named Tajuddin in Golapganj during the anti-discrimination student movement in Sylhet. 
 
The court has sought permission to file a case against him for non-cooperation and disobeying the court order.
 
 On Sunday (March 1), the Secretary of the Ministry of Public Administration was directed to obtain the necessary legal permission in this regard. 
 
According to the case source, an anti-discrimination movement was going on in front of the Upazila Health Complex in Dharabahor area of Golapganj upazila on the afternoon of August 4, 2024. At that time, a person named Tajuddin was shot and died in police firing. In this incident, the wife of the deceased, Ruli Begum, filed a murder case with Golapganj Police Station. In the case, it is alleged that her husband was killed in the firing of law enforcement agencies. 
 
The Police Bureau of Investigation (PBI) Sylhet has been given the responsibility to investigate the case. PBI Inspector Noor Mohammad applied to the Deputy Commissioner and BGB Srimangal Deputy Director General for information on the name of the executive magistrate in charge of the area and on whose orders the shooting was carried out. As per the court's order, the BGB provided them with the necessary information and a list of members. Sylhet District Magistrate Md. Sarwar Alam did not provide any information in this regard. Despite repeated requests, he did not provide the desired information to the investigation officer, resulting in the investigation of the case being stalled. On February 8, the court issued a show cause notice to the DC to show cause within 15 working days due to non-cooperation in the investigation. However, he did not respond within the stipulated time.
 
 Then, on February 23 and March 1, he did not give any explanation to the court. Sudipto Talukder, Senior Judicial Magistrate of Sylhet Judicial Magistrate 1st Court, mentioned in his observation that repeatedly ignoring the court's orders as a high-ranking government official is not only illegal, but also an extreme obstacle to establishing justice and the rule of law. Such actions of the DC are punishable under Sections 175, 179 and 217 of the Penal Code and Section 485 of the Criminal Procedure Code. According to the existing law, prior permission of the government is required to start the process of a criminal case against a government employee. In this regard, the court has ordered the Secretary of the Ministry of Public Administration to obtain the necessary legal permission by April 15 and inform the court.
 
 In this regard, Sylhet Deputy Commissioner Md. Sarwar Alam said that the necessary documents have been submitted within the 15-day period given by the court. He claimed that there is a lack of coordination on the part of the PBI in this regard. A letter was given once from their side, but no further communication was made. The issue is being unnecessarily created. The main culprit here is the police.
